How to Notarize for Physically Impaired Signers

2023-02-01に共有
You may need to notarize a document for someone with a physical condition that makes them unable to sign it. Learn more here: bit.ly/3WLKCro

When this comes up, you can handle it in the following ways:

1. Powers of attorney: When the customer gives someone the power of attorney to sign documents on their behalf. That person is called a “representative signer.”
2. Signatures by mark: When someone who can’t put their signature on a document is allowed to sign with an “X” or similar mark.
3. Signatures by proxy: When the customer directs someone to sign a document on their behalf.

Remember to check your state’s rules to know how to proceed with any of these options. More information on your state’s Notary laws can be found here: nationalnotary.org/laws

If your customer does not meet the requirements for these signing alternatives, you should not complete the notarization. Your client will need to contact an attorney for information on how to sign the document.

Can the representative signer or attorney in fact be a family member in need of access to the Impaired signer Information like to be an authorized user on the impaired person account?
