As a German I expect they would have issued an arrest warrant for Sir Winston Churchill as well. He was lucky that this type of "justice" had not been invented back then.

Its not up to politicians to decide who is a war criminal and who is not;) If it would be up to them no politician would ever go to jail. Thats why ICC exist.
