In one of its most pivotal decisions of the year, the US Supreme Court has ruled that US presidents can have absolute immunity for ‘official’ acts.

The 6-3 historic decision effectively strips out key parts of an indictment against former president Donald Trump for allegedly conspiring to overturn his 2020 election defeat.

Three justices have issued a blistering dissent to the US Supreme Court opinion granting Trump partial immunity from prosecution, warning that it will allow presidential power to be used "for evil ends".

Six conservative-leaning justices signed the majority opinion, but the three liberals dissented, expressing "fear for our democracy".

But how far could the leader of the free world push the definition of a presidential duty?

On this week’s Americast, the BBC’s Sarah Smith and Anthony Zurcher discuss this question with constitutional law expert Alison LaCroix and Steve Bannon, former strategist for Donald Trump.

The same judges who say "yes" now will be the first to say "no" depending on which President exactly was in question! For example, one wonders if Obama could've gotten away with a fraction of all what Trump has said and done. One just wonders!

My question is, after the Supreme Court ruled on USA president immunity . Can the American president fire all Supreme Court Justices and replace them with new ones ?
  • @Chris-Longhair
If it is impossible for consequences to be brought upon a perpetrator of a crime, that crime is decriminalised, de facto legal.
  • CRITICAL THINKING: How can the president be held accountable for crimes, if evidence of their crimes cannot be reviewed by any court in America?

Sounds like your analyst is saying that anything trump has done is covered by immunity, but anything Biden could think up to do to thwart trump would be off limits and not covered by immunity.
  • Just to clear this up, the Monarchy IS NOT above the law. Rule of law means nobody is. The King could be prosecuted, you do not need the crown to prosecute, private prosecutions happen all the time, ask the RSPCA.

Please drop the cowboy music. Some of us in America are self-educated and know the score on many complicated issues. Try some classical please.
  • So tragic, the fate of the United States, and all because in 2016 some number of people didn’t like the sound of a woman’s voice.
  • Unfortunately trump knows that Biden is not hard harden like him. He has a conscious and wants to do whats right not cruel. But many wishes he would. Trump will use this ruling if rlected and end democracy.
